What it is?
Geographical indication, in relation to goods, means an indication which identifies such goods as agricultural goods, natural goods or manufactured goods as originating, or manufactured in the territory of a country, or a region or locality in that territory, where a given quality, reputation or other characteristics of such goods is essentially attributable to its geographical origin and in case where such goods are manufactured goods one of the activities of either the production or of processing or preparation of the goods concerned takes place in such territory, region or locality, as the case may be.
Benefits
To the registered proprietor, and the authorized user or users thereof –
- The right to obtain relief in respect of infringement of the geographical indication in the manner provided by the Geographical Indications of Goods Act, 1999.
To the authorize user –
- The exclusive right to use the geographical indication in relation to the goods in respect of which the geographical indication is registered.
Who may apply for geographical indication?
- Any association of persons
- Any association of producers
- Any organization
- Any authority
Representing the interest of the producers of the concerned goods, who are desirous of registering a geographical indication in relation to respective goods.
Duration
The registration of a geographical indication is initially for a period of ten years, which may be renewed for period of ten years, from time to time.
Who may apply for registration as authorized user of geographical indication?
- Any person claiming to be the producer of the goods in respect of which a geographical indication has been registered.
Duration
The registration of an authorized user shall be initially for a period of ten years, or for the period till the date on which the registration of the geographical indication in respect of which the authorized user is registered expires, which ever is earlier.
